Aşağıdaki Taraflar işbu SÖZLEŞME ile aşağıda belirtilen hüküm ve şartları kabul, beyan ve taahhüt etmişlerdir. Taraflar bundan sonra birlikte “Taraflar” ve her biri ayrı olarak “Taraf” olarak anılacaktır.

İşbu SÖZLEŞME’yi kabul etmekle ALICI, Sözleşme konusu siparişi onayladığı takdirde sipariş konusu bedeli ve varsa kargo ücreti, vergi gibi belirtilen ek ücretleri ödeme yükümlülüğü altına gireceğini ve bu konuda bilgilendirildiğini peşinen kabul eder.

2. TANIMLAR
İşbu SÖZLEŞME’nin uygulanmasında ve yorumlanmasında aşağıda yazılı terimler karşılarındaki yazılı açıklamaları ifade edeceklerdir.

KANUN: 6502 sayılı Tüketicinin Korunması Hakkında Kanun’u,
YÖNETMELİK: Mesafeli Sözleşmeler Yönetmeliği’ni
HİZMET: Bir ücret veya menfaat karşılığında yapılan ya da yapılması taahhüt edilen mal sağlama dışındaki her türlü tüketici işleminin konusunu,
SATICI: Ticari veya mesleki faaliyetleri kapsamında tüketiciye mal sunan veya mal sunan adına veya hesabına hareket eden şirketi,
ALICI: Bir mal veya hizmeti ticari veya mesleki olmayan amaçlarla edinen, kullanan veya yararlanan ve mal veya hizmeti SATICI’ya ait internet sitesi üzerinden talep eden gerçek ya da tüzel kişiyi,
SİTE: SATICI’ya ait internet sitesini,
TARAFLAR: SATICI ve ALICI’yı,
SÖZLEŞME: SATICI ve ALICI arasında akdedilen işbu sözleşmeyi,
MAL/ÜRÜN: Alışverişe konu olan taşınır eşyayı ve elektronik ortamda kullanılmak üzere hazırlanan yazılım, ses, görüntü ve benzeri gayri maddi malları.

3. KONU
İşbu SÖZLEŞME, ALICI’nın, SATICI’ya ait SİTE üzerinden elektronik ortamda siparişini verdiği nitelikleri ve satış fiyatı belirtilen ürünün satışı ve teslimi ile ilgili olarak 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği hükümleri gereğince tarafların hak ve yükümlülüklerini düzenler.

Listelenen ve SİTE’de ilan edilen fiyatlar satış fiyatıdır. İlan edilen fiyatlar ve vaatler güncelleme yapılana ve değiştirilene kadar geçerlidir. Süreli olarak ilan edilen fiyatlar ise belirtilen süre sonuna kadar geçerlidir.

6. SÖZLEŞME KONUSU ÜRÜN
İşbu sözleşme konusu ürün/ler, ALICI tarafından SATICI’ya ait internet sitesi üzerinden sipariş verilen ürün/ler olup, ürünler SİTE’de belirtilen fiyatlar üzerinden satılacaktır. Ürünler, ALICI’nın sipariş ve ödeme onayı sonrasında sevk edilecektir. Sipariş verilen ürünün özellikleri, adet fiyatı, toplam fiyatı gibi detaylar sipariş esnasında ALICI’ya bildirilir. ALICI, siparişi ile birlikte tüm bu bilgileri kabul eder.

7. ÜRÜN FİYATI VE ÖDEME
İşbu sözleşme konusu ürünler, SATICI’nın internet sitesinde belirtilen fiyat üzerinden satılacaktır. ALICI, internet sitesinde yer alan ödeme yöntemleri aracılığıyla ödeme yapacaktır. ALICI ödeme için kredi kartı, banka kartı ya da diğer ödeme yöntemlerini kullanabilecektir. Ürün bedeli, sipariş onayının ardından ALICI’dan tahsil edilecektir.

8. TESLİMAT VE GÖNDERİM
Sipariş edilen ürünler, ALICI’nın belirtilen teslimat adresine en geç 30 gün içinde teslim edilecektir. Ancak, ürünlerin teslimatı için ALICI’nın onayı alınarak kargo firmasına teslimat yapılır. Ürünler kargo ile gönderilecektir ve kargo ücreti, ALICI’ya ait olacaktır.

9. CAYMA HAKKI
ALICI, sözleşmenin akdedilmesinden itibaren 14 (ondört) gün içinde hiçbir gerekçe göstermeksizin ve cezai şart ödemeksizin cayma hakkına sahiptir. Cayma hakkının kullanılması için SATICI’ya yazılı olarak başvurulması gerekmektedir.

10. GARANTİ VE İADE ŞARTLARI
ALICI, teslim aldığı ürünü sadece ambalajı bozulmamış ve kullanılmamış durumda iade edebilir. Ürünün kullanılmaya başlanması durumunda iade kabul edilmez. Ürünle ilgili herhangi bir garanti durumu söz konusu ise, garanti şartları ürünle birlikte verilecektir.

11. YÜKÜMLÜLÜKLER
SATICI, ürünün zamanında teslimatını sağlamak ve ürün ile ilgili gerekli tüm bilgilendirmeleri yapmakla yükümlüdür. ALICI, sipariş verdiği ürünün bedelini zamanında ödemekle ve doğru teslimat adresi vermekle yükümlüdür.

12. HUKUKİ YÜKÜMLÜLÜKLER
İşbu sözleşme hükümleri, Tüketicinin Korunması Hakkında Kanun, Mesafeli Sözleşmeler Yönetmeliği ve ilgili diğer mevzuata tabidir. Taraflar arasında çıkabilecek uyuşmazlıklarda İstanbul Mahkemeleri ve İcra Daireleri yetkili olacaktır.

13. SÖZLEŞME DEĞİŞİKLİĞİ
İşbu sözleşme, taraflardan herhangi birinin karşılıklı mutabakatı ile değiştirilebilir. Değişiklikler, yazılı olarak yapılmalı ve her iki tarafça imzalanmalıdır.

Taraflar işbu sözleşmenin tüm maddelerini okuduklarını ve kabul ettiklerini beyan ederler.

By accepting this CONTRACT, the BUYER agrees and acknowledges that if the order subject to the contract is confirmed, the BUYER will be under the obligation to pay the price of the ordered item and any additional fees such as shipping costs, taxes, etc., and has been informed about this in advance.

2. DEFINITIONS
   In the application and interpretation of this CONTRACT, the following terms will have the meanings specified below.

LAW: The Law No. 6502 on the Protection of Consumers,
REGULATION: The Regulation on Distance Contracts,
SERVICE: Any consumer transaction subject to a fee or benefit other than the provision of goods,
SELLER: The company providing goods to the consumer within the scope of its commercial or professional activities or acting on behalf of or for the account of a company that provides goods,
BUYER: A real or legal person who acquires, uses, or benefits from a product or service for purposes other than commercial or professional ones and requests the product or service from the SELLER’s website,
SITE: The website owned by the SELLER,
PARTIES: The SELLER and the BUYER,
CONTRACT: This contract entered into between the SELLER and the BUYER,
PRODUCT/ITEM: The movable goods subject to the shopping and intangible goods such as software, audio, video, and similar content prepared for use in electronic form.

3. SUBJECT
   This CONTRACT regulates the rights and obligations of the Parties in relation to the sale and delivery of the product with the specified characteristics and sale price that the BUYER ordered electronically from the SELLER’s SITE, in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

The prices listed and announced on the SITE are the sale prices. The announced prices and promises are valid until they are updated or changed. Prices announced for a limited time will be valid until the specified period expires.

6. PRODUCT SUBJECT TO THE CONTRACT
   The products subject to this contract are the items ordered by the BUYER from the SELLER’s website. These items will be sold at the prices indicated on the SITE. The products will be shipped after the BUYER’s order and payment confirmation. The details such as the product’s features, unit price, total price, etc., will be provided to the BUYER during the ordering process. The BUYER accepts all these details along with the order.

7. PRODUCT PRICE AND PAYMENT
   The products subject to this contract will be sold at the price listed on the SELLER’s website. The BUYER will make the payment through the payment methods available on the website. The BUYER may use a credit card, debit card, or other payment methods. The product price will be collected from the BUYER after the order confirmation.

8. DELIVERY AND SHIPPING
   The ordered products will be delivered to the BUYER’s specified delivery address within 30 days at the latest. However, the products will be delivered to the courier company after obtaining the BUYER’s approval. The products will be sent by cargo, and the shipping fee will be borne by the BUYER.

9. RIGHT OF WITHDRAWAL
   The BUYER has the right to withdraw from the contract within 14 (fourteen) days from the conclusion of the contract without giving any reason and without paying any penalty. To exercise the right of withdrawal, the BUYER must submit a written request to the SELLER.

10. WARRANTY AND RETURN CONDITIONS
    The BUYER can only return the product if it is unopened and unused. If the product has been used, returns will not be accepted. If there is a warranty condition for the product, the warranty terms will be provided with the product.

11. OBLIGATIONS
    The SELLER is obligated to ensure the timely delivery of the product and to provide all necessary information regarding the product. The BUYER is obligated to pay for the ordered product on time and provide the correct delivery address.

12. LEGAL OBLIGATIONS
    The provisions of this contract are subject to the Law on the Protection of Consumers, the Regulation on Distance Contracts, and other relevant legislation. In case of any disputes between the Parties, the courts and enforcement offices of Istanbul will have jurisdiction.

13. AMENDMENT TO THE CONTRACT
    This contract can be amended by mutual agreement of the Parties. Any amendments must be made in writing and signed by both Parties.

The Parties declare that they have read and accepted all the terms of this contract.
